Terms of Service

1. About us
This app is a business management service for UK Approved Driving Instructors (ADIs) and trainee driving instructors (PDIs), with online booking, a learner portal and learner accounts for their pupils. It is operated by DriveTech Group Limited, a company registered in England and Wales ("we", "us"). By creating an account, or by booking or paying for a lesson through the app, you agree to these terms. Sections 2 to 9 apply to instructors, section 10 applies to learners, and the rest apply to everyone.
2. Your instructor account
- You must be a registered ADI or a trainee driving instructor (PDI) to use the instructor app
- You are responsible for keeping your login credentials secure
- You must provide accurate information when registering
- One account per instructor. Driving schools may provision accounts for their instructors via enterprise licence keys or invitations
3. Fees and payment
- The app is free for driving instructors and trainee instructors. There is no subscription and no trial, and we do not ask for a card to use the app
- Enterprise accounts are billed to the driving school. Individual instructors activated via an enterprise licence key are not charged
- Online bookings require card payment. To take online bookings you must connect a Stripe account. Learners pay by card when they book online, and can pay for further lessons and outstanding balances through their portal
- Every lesson booked or paid for through the app carries a learner-paid booking fee: the greater of £2.99 or 4% of the lesson price. It is shown to the learner as a separate line, with the total, before they pay
- The booking fee is charged by us for the booking and payment service. It is added on top of your price, paid by the learner and kept by us. It is not deducted from your payout
- No booking fee applies to lessons a learner arranges and pays for directly with you outside the app, or to lessons taken from a block the learner has already paid for
- If you refund a payment, the booking fee is refunded in the same proportion
- We may change the booking fee with 30 days' notice
4. Optional paid extras
- Marketplace introductions: if you turn on marketplace visibility, a one-off finder's fee (currently £30) is deducted from your payout for a new pupil's first booking made through our marketplace. It applies once per new pupil and not to repeat lessons with the same pupil
- Lead credits: you can buy credit packs to unlock the contact details of learners looking for lessons near you. Prices are shown before you buy, and payment is taken via Stripe
- These extras are optional. Not using them does not limit your use of the app
- We may change the price of an optional extra with 30 days' notice
5. Acceptable use
You agree not to:
- Use the app for any unlawful purpose
- Attempt to access other users' data
- Reverse engineer, copy, or resell any part of the service
- Upload malicious code or attempt to disrupt the service
- Use the service to send unsolicited communications to pupils
6. Your data and your account
You own your data. We process your pupils' data on your behalf to provide the service. You can download a copy of your data (JSON format) at any time from Settings. We retain data for the periods set out in our Privacy Policy.
You are responsible for having a lawful basis, and giving your pupils the information they need, before entering their personal data into the app, and for complying with UK GDPR in your use of the service.
You can delete your account at any time in Settings. We then delete or anonymise your personal data and your pupils' records, keeping financial records for as long as the law requires, as described in the Privacy Policy.
7. Driving schools
If you join a driving school's account (for example through a licence key or an invitation), the school can see your name, contact details and coverage area, how many learners you have and need, and your learners' names and lesson and test progress. If the school connects its own customer system (CRM), we send it your name, email address and postcode, your learner numbers, and updates such as learner requests and whether you accept a learner it introduced. Learners the school introduces arrive with their contact details, which you may use only to provide their lessons. When you leave the school, it stops receiving new information about you.
8. Making Tax Digital and HMRC submissions
Where HMRC has granted our software access for live submissions, the app can submit Income Tax Self Assessment updates to HMRC on your instruction via the Making Tax Digital for Income Tax API. You are responsible for the accuracy of financial data entered and for approving each submission. We are not liable for penalties arising from incorrect submissions based on data you have provided.
When you use HMRC features, we are required by law to submit fraud prevention headers with each API request. These include technical data such as your IP address, device identifiers, and browser information. See our Privacy Policy for details.
9. Notifications
If you allow them, the app sends push notifications to your device, for example about lessons, messages and reminders. You can turn them off at any time in your browser or device settings. Service emails about your account, bookings and payments are part of the service. You can ask us to stop marketing emails at any time.
10. Learners
- Your lessons. Your agreement for driving tuition is with your instructor, who sets the lesson price, notice period and cancellation charges. You accept your instructor's lesson terms in your portal. We supply the booking, payment and record-keeping app and are not a party to your tuition agreement
- Learner accounts are free. You can use one to see your lessons and progress and to practise for your theory test, with 10 free practice questions a day
- Booking fee. Lessons you book or pay for through the app carry a booking fee of the greater of £2.99 or 4% of the lesson price. Online bookings are paid by card when you book, and a booking is confirmed once it has been paid for. The fee and the total are shown before you pay. The fee is charged by us for the booking and payment service; it is not part of your instructor's price and your instructor does not keep it. There is no booking fee on lessons you arrange and pay for directly with your instructor outside the app, or on lessons taken from a block you have already paid for. If a payment is refunded, the booking fee is refunded in the same proportion
- Theory Premium costs £2.99 a month and unlocks unlimited practice questions, mock tests, hazard perception and progress analytics. It is billed through Stripe, renews automatically every month until you cancel, and has no minimum term. You can cancel at any time from your account (Manage subscription); cancelling stops all future payments. Premium isn't available inside the store-installed apps
- Your 14-day right to cancel. As a consumer you normally have 14 days to cancel a contract made online. Theory Premium is digital content that starts as soon as you pay, so when you upgrade we ask you to agree to it starting straight away and to acknowledge that you then lose that 14-day right. This does not affect your right to cancel future payments at any time, or your legal rights if the content is faulty
- Deleting your account. You can delete your learner account at any time in your account settings. This cancels any Theory Premium subscription and deletes your login, profile and theory practice history. Your instructor keeps their own records of your lessons and payments, which they need for their business and tax records
11. Availability and support
We aim to maintain 99.5% uptime but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible. Support is provided via email at hello@orbitdriving.com.
12. Limitation of liability
To the maximum extent permitted by law, DriveTech Group Limited is not liable for indirect, incidental, or consequential losses arising from your use of the app. Our total liability to you in any 12-month period is limited to the greater of £100 and the total amount you paid us in that period (for example booking fees, optional extras or Theory Premium).
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law. If you use the app as a consumer, nothing in these terms affects your statutory rights, and we are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill.
13. Suspension and closing your account
We may suspend or terminate your account if you breach these terms, misuse the payment features (for example fraud or abusive chargebacks), or use the service in a way that damages other users or the service itself. We will give you notice except in cases of serious breach. You can close your account at any time from your account settings.
14. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer living in Scotland or Northern Ireland you may also bring proceedings in your local courts.
15. Changes to these terms
We may update these terms from time to time. We will notify you of material changes by email with at least 14 days' notice. Continued use after the effective date constitutes acceptance.
